The Mossos d’Esquadra have identified five minors, three of whom are under 14 years of age and are therefore unimputable, accused of sexually assaulting two high school classmates in El Vendrell (Tarragona), aged 12, in the school yard.
According to El Diari de Tarragona and sources close to the investigation have confirmed to EFE, the alleged sexual assaults occurred on March 3 during playground time at the Àngel de Tobies School Institute, when the five minors allegedly assaulted two children of 12 years.
The Tarragona court has issued a precautionary measure for these two 15-year-old minors from El Vendrell, supervised release and the prohibition to communicate and approach the two victims within 50 meters, as advanced by El Diari de Tarragona.
The Mossos identified the five children and last Friday, March 10, they questioned two of the alleged perpetrators as investigated, who allegedly touched their two companions above their clothes.
The rest of the alleged aggressors involved, under 14 years old, cannot be charged with a crime as they are unimpeachable. However, the General Directorate of Child Care and Adolescence (DGAIA) opens a file on these minors and studies each case.
The General Directorate of Child Care and Adolescence (DGAIA) of the Generalitat opened a case against 1,023 unaccountable minors, that is, under 14 years of age, of which 10% were related to crimes against sexual freedom , in 2022.
The attention service for unimputable minors (EMI-14) is the one that takes care of these young people, within the framework of the Educando en la responsabilidad program. The EMI-14 team of professionals assesses each case and conducts a study of the alleged aggressor and her personal, social and family situation, “to address the risk factors that may generate anti-social behavior in the future.”
The parents of the minor are also summoned to assess the family situation, if there is a lack of protection and, if it is considered necessary, this adolescent is accompanied with therapy from the same EMI-14 for one year, on average.
As a result of the sexual assault that occurred in Badalona (Barcelona), the Ministry of Education of the Generalitat warned last Friday that the right to schooling of minors under 14 years of age cannot be denied, who are not criminally responsible, who allegedly participated in the group sexual assault on an 11-year-old girl, who was attacked in a shopping center in Badalona, ??since this would mean violating the legal system.
