New recklessness behind the wheel. The Command of the Civil Guard of Palencia is investigating a driver who on April 3 was driving drugged at 198 km/h on the A-73 highway (Burgos-Aguilar de Campoo). In addition, the man had an expired license and was traveling with a child in the back seats.

The agents detected him at kilometer point 63.5 during a speed, alcohol and drug control. The vehicle was traveling at almost 200 km/h, twice the speed allowed in that section, limited to 100 km/h when one of the two lanes of the A-73 highway was removed, at the link with the N-627.

The civil guards who stopped him verified that he was driving the car without a valid driving license. In addition, the result of the drug test that was carried out on him was positive. For all this, the motorist faces an alleged crime against road safety.

It should not be forgotten that there are some speeding violations that carry prison sentences. When the speed allowed on urban roads or 80 km/h on interurban roads is exceeded by 60 km/h, the Penal Code classifies it as a crime and punishes it with imprisonment for three to six months, a fine of six to twelve months or jobs. for the benefit of the community from 31 to 90 days. In addition, in any case, the deprivation of driving motor vehicles from one to four years will be decreed.

If driving with manifest recklessness, above the aforementioned limits, and endangering the life and integrity of other road users, the prison sentence would increase from six months to two years and the withdrawal of the license could be raised up to 6 years.

On the other hand, driving under the influence of drugs can also lead to prison. Article 379 of the Criminal Code contemplates penalties for the offender ranging from 3 to 6 months in prison and the deprivation of the right to drive motor vehicles and mopeds between 1 and 4 years. In addition, it carries a fine of 1,000 euros and the withdrawal of six points from the driving license as it is considered a very serious offense. Refusing to take the control test entails imprisonment from six months to one year and deprivation of the right to drive from one to four years.

Finally, driving a vehicle with an expired permit only carries a fine of 200 euros; there is not even deduction of points. It should be remembered that the renewal of the card can be carried out up to three months before it expires, without this implying a notification of its validity, that is, the new permit starts counting from the day the old one expires.
