The forensic experts hired by Laura Borràs affirm that the hard drives containing the emails that incriminate her were altered. They have affirmed it in the penultimate session of the trial against the leader of Junts for the alleged splitting of contracts when she directed the Institució de les Lletres Catalanes. However, the Civil Guard agents have attested that the files did not undergo any modification.
In a very technical explanation, the experts Luís Enrique Hellín and Javier Rubio have explained that the original files had a fingerprint that did not match the copy that was delivered to the parties and on which the Civil Guard based its investigation. However, the experts have never denied that the emails incriminating Borràs were not written by her and they base their criticism on how they were obtained.
“The two hashes (fingerprint) do not match”, he indicated, with which “it can be guaranteed that there is a different content. Based on the hash calculation, the hash is not the same, the data on the hard drives is not the same, therefore the content is different”, the expert pointed out. One of the alterations denounced by Borràs’ defense is that when the Mossos dumped the files from Herrero’s computer they created a folder on the desktop under the name “Mossos” in which they downloaded the files they considered of interest and therefore they understand that It was modified from the beginning.
The specialists issued a report that has been delivered analyzing the hard drives and the extraction of the data made by the Mossos d’Esquadra and that served to put together the accusation against Borràs, his friend Isaías Herrero and the third defendant, Andreu Pujol. On those hard drives were found the emails in which Borràs gave instructions to his friend on how to cut up contracts.
In their study, presented to the court, the experts concluded that “the chain of custody of the discs can be called into question because their fingerprints are not calculated” and that the Mossos went too far when it came to extracting all the contents of the records. computers and email accounts of Isaías Herrero. “The enabling court order at no time authorizes or reasons that the agents can access and copy the emails that they could find from Mr. Herrero on their computers,” they said. And they reiterate that “the police examination of the emails accessed and copied without the mandatory judicial authorization has allowed the agents to configure the crimes that are reflected in their reports.”
However, the agents of the Civil Guard technological group have attested that the content was not modified and that the dump made of the original files was not modified. “Its content cannot be altered. There is no ability to alter the content, ”said one of those responsible. Borràs’ lawyer, Gonzalo Boye, wanted with his interrogation to raise doubts about the integrity of the files that incriminate his client. Can it be guaranteed with total certainty that there has been no alteration of the hard drives since the day they were seized by the Mossos or is it a matter of faith?” Boye inquired. “Yes, it can be guaranteed,” the Civil Guard responded.
La Benemérita took over the investigation in January 2019 after the Barcelona investigating judge 9 expelled the Mossos, who initially took up the cause. From that moment on, they had to dump all the content that the Catalan police had obtained.
