The Supreme Court has confirmed the sentence to 26 years and nine months in prison for a man who murdered his partner after giving him a “terrible beating” in front of his son, aged a year and a half, when they had spent hours before celebrating his birthday together in the house, despite having a restraining order in effect.

The Criminal Chamber has issued a sentence, to which EFE has had access, which rejects the appeal of the convicted person against the resolution of the Superior Court of Justice of Catalonia that confirmed another of the Court of Barcelona for crimes of murder with treachery and cruelty , with the aggravation of kinship and gender, another of habitual violence in the family environment and another of breach of sentence or precautionary measure.

The convicted person, who sometimes used a false identity and resided irregularly in Spain, and the victim began their relationship in Peru in 2017 and then moved to Hospitalet de Llobregat (Barcelona), where they lived with their son, aged one year and six months.

From “the beginning of the relationship”, the condemned man “showed an extremely dominant, violent and aggressive character”, subjecting the woman to “degrading and humiliating treatment with psychological violence and repeated physical attacks”.

Moreover, their relationship was characterized by “regular arguments, fights, and some assaults reported by the victim, due to her jealous, possessive, and dominant nature, humiliation toward her partner, and absolute contempt for her condition as a woman.”

On August 28, 2018, the woman reported an assault, which started a criminal proceeding, and another on June 29, 2019, in which the Court for Violence against Women number 1 of Hospitalet agreed on a restraining order against the aggressor who prohibited coming closer than 1,000 meters and communicating with her.

Despite having “full knowledge of the prohibitions imposed” and “of the consequences of non-compliance”, the convicted person went to the family home on July 31 and, the next day, both spent the whole day together, went out to eat with some friends and they returned to the house, where they remained until the next day.

That second night they stayed until the wee hours of the morning celebrating her birthday in an affectionate attitude and with the child asleep on the sofa, as two neighbors verified.

However, when they went to the bedroom and in the presence of the child, the condemned man “hit her with extreme violence and force all over her body, with punches and kicks,” causing “numerous bruises, abrasions, and abrasions on the head, thorax, abdomen, and extremities.” superiors and inferiors”. The injuries were so serious that the woman died hours later.

The sentence says that the convicted man assaulted her with “the intention of ending her life” without being drunk or drugged and that she, in full celebration of her birthday, “was surprised by the brutal attack, without having any chance to defend herself.”

In addition to the prison sentence, the Supreme Court ratifies the withdrawal of parental authority during the time of the sentence, the prohibition to communicate or approach his son for 37 years and compensation of 200,000 euros to his son and family members.
