1. OBJECT
La Vanguardia Ediciones, S.L.U., a company duly constituted under Spanish law, with registered office at Avenida Diagonal, 477, planta 9, 08036, Barcelona and NIF number B-61.475.257 (hereinafter, and for the purposes of these bases, LA VANGUARDIA EDICIONES, S.L.U., will be referred to as “LVâ€), publisher of Canal Comer de La Vanguardia, in order to reward its readers, organizes the following literary contest (the “Contestâ€) that aims to encourage creativity and writing gastronomy, and whose award-winning work will be published in its entirety in the print edition and on the website of La Vanguardia (the “Prizeâ€).
LV reserves the right to prevent speculation or business systems from being established on this Contest or any other that may lead to its alteration or manipulation. To this end, it may exercise all the actions it deems appropriate, including the exclusion from this Contest of any participant who acts in this regard.
2. RIGHT TO PARTICIPATE
Any natural person, of legal age, residing in Spanish territory can participate in the Contest.
Those people who are linked by employment relationship to any company belonging to GRUPO GODO DE COMUNICACIÓN, S.A. may not participate in the promotion. as well as their spouses and relatives up to the second degree of consanguinity. Failure to comply with this rule will mean the automatic exclusion from the promotion and, where appropriate, the loss of the Prize obtained.
Participation in the Contest will be done by: (i) Sending an original text by email to relatocorto.comer@lavanguardia.es, indicating the Familia Torres Award for Gastronomic Story in the subject line.
(ii) compliance with the participation instructions; and
(iii) acceptance of the bases.
Participation in this Contest presupposes the full acceptance of all the clauses contained in these rules and the authorization to publish the name and photograph/s of the winner/s in the communication media of La Vanguardia and other Grupo Godó media, in all its editions on paper as well as in online media (by way of example, emailing, web, app, social networks and RRSS), reserving the right to use the Prize for advertising, the name and image of the winner if it deems appropriate, without this entailing financial compensation. some in favor of the winner.
3. DURATION AND SCOPE
The Contest is valid only for the Spanish territory. The Contest will begin at 00:00 on April 29, 2023 and you can participate until 23:59 on July 3, 2023, both inclusive. The decision of the jury, made up of six members, will be made public on October 2, 2023, during a gala.
LV reserves the right to suspend, postpone, cancel or modify the duration of the Contest at any time prior to its completion, provided that there are causes of force majeure that justify it, that is, causes that could not have been foreseen, or that, anticipated, were unavoidable, or causes not attributable to LV.
In the event that, due to the aforementioned causes, it is necessary to change the dates of the Contest, LV will communicate said modifications to all participants by email or by other means at its disposal.
In any case, LV will be exempt from any obligation to compensate the participants, if the aforementioned causes occur or if, due to legal imperative, the Contest is suspended or cancelled. In the event that such a situation occurs, the participants will be duly informed as soon as reasonably possible.
4. DESCRIPTION OF THE PRIZES

5. REQUIREMENTS TO PARTICIPATE. CONTENT OF THE STORY
Each participant may send an unpublished and original text, with a minimum of 5,000 characters and a maximum of 12,000 characters, in any of the official languages ​​of the Spanish State.
We understand a gastronomy story as that fictional text in which cooking, gastronomy or nutrition play an important role in the plot.
The text must be sent by email to relatocorto.comer@lavanguardia.es and in the subject line indicate the Familia Torres Award for Gastronomic Story. The work, which must be titled, will be delivered in PDF format and the data of the participating person must be attached: Name, surname, date of birth, address, postal code, city and telephone.
It is allowed to submit the story signed with a pseudonym, in which case a sealed envelope must be sent by mail with the author’s data and contact, which will only be opened in the event that their work is a winner to the postal address of Comer La Vanguardia: Diagonal Avenue, 477 16th floor 08036 Barcelona.
The original non-award winning texts will not be returned to the participants.
Each participant may participate only once.
The participants guarantee that the text sent is original and unpublished. In the event of any suspicion of false information or authorship fraud, LV may disqualify the contestant with reservation of other actions that may correspond to him.
6. SELECTION OF THE WINNER AND DELIVERY OF PRIZES
The decision of the jury, made up of six members, will be made public on October 2, 2023, during a gala. Before and after the jury’s decision, only the winner will be contacted, who must commit to attending the gala in which they will receive the prize, endowed with 3,000 euros, and whose winning work will be published in its entirety in the printed edition. and on the La Vanguardia website.
The jury’s decision will be final and will be made by a simple majority of its members. The jury will reserve the right to consider the prize void.
The winning person will receive the prize on the date and in the place indicated, for which purpose they will sign the corresponding reception documents. In the event that the winner of the prize renounces it, said prize will be forfeited. The non-appearance of the winning person on the day designated for the delivery of the prize will entail the resignation of the prize. The person who wins the prize must deliver to LV, as an essential condition for the delivery of the corresponding prize, the duly completed and signed acceptance letter that is attached to these bases as Annex I.
7. ACCEPTANCE OF THE RULES
Contestants may consult the rules of the Contest on the Comer Channel of La Vanguardia located at www.lavanguardia.com/comer.
The participant expressly agrees to comply with each and every one of the bases of this Contest. Failure to comply with any of the bases will lead to the exclusion of the participant from this Contest. In case of doubts or discrepancies in the interpretation of these bases, the LV criteria will prevail.
Exceptionally and for duly justified reasons, LV may modify these rules once the Contest has started, in which case the new rules will be published again on the Comer channel of La Vanguardia and will enter into force on the day of their publication. In the case of the previous paragraph, if the participant does not withdraw from the contest, it will be understood that he accepts the new conditions. 8. TAX TREATMENT
The provisions set forth in Law 35/2006 of November 28, on Personal Income Tax and partial modification of the Laws on Company Taxes, on Non-profit Income will apply to the Prize of this Contest. residents and on patrimony and Royal Decree 439/2007, of March 30, which approves the Personal Income Tax Regulations and modifies the Pension Plans and Funds Regulations, approved by Royal Decree 304/2004, of February 20; by virtue of which the prizes awarded for participation in games, contests, raffles or random combinations, whether or not they are linked to the offer, promotion or sale of certain goods, products or services, will be subject to withholding or account payment provided that the prize retention base is greater than 300 euros.
LV will pay, if applicable, to the Public Treasury the amounts withheld on behalf of the winner, also committing itself to comply with the information obligations to the Tax Agency and the winner derived from the awarding of the Prize. In the case of prizes in kind, and when the practice of payment on account proceeds, this will be borne by LV and, therefore, for tax purposes it will constitute more value of the Prize. In the case of cash prizes, the withholding will be passed on to the winner, who will receive the net between the full value of the prize and the withholding made. For its part, the Prize obtained in this promotion will be subject to the pertinent tax obligations in the Income Tax declaration of the winner’s natural persons.
The prize will only be valid for natural persons, tax residents in Spain, expressly excluding from this Contest the participation of legal entities and natural persons who, from a fiscal point of view, are not considered residents of Spain.
The completion of the winner’s personal fiscal data necessary for the delivery of the Prize is mandatory, so that the absence of any of said data will mean the loss of the right to the Prize obtained.
9. IMAGE USE CONSENT
The winner in the Contest expressly authorizes LV to use and disclose his image (including his name and voice) and, for this purpose, assigns his image rights for the capture, exploitation, reproduction, publication, transformation and public communication through television, Internet, graphic media, as well as through any other media or broadcast channels that, where appropriate, may exist, without limitation, without any consideration being derived from it and expressly waiving any image right in this regard. .
In the same way, you authorize, in the terms set forth in this document, the use and exploitation of the photographs that may be taken of your image, within the framework of the development and management of the aforementioned action.
10. ASSIGNMENT OF INTELLECTUAL PROPERTY RIGHTS AND EXPLOITATION RIGHTS
Participation in this Contest entails the transfer of copyright and image rights, including the right of reproduction or distribution and public communication in the newspaper, social networks, web pages and any other means of La Vanguardia and Grupo Godó, without any neither temporal nor geographical limitation. Likewise, the rights to translate into other languages, transform into audio, include in compilations in book format, make derivative works, as well as the assignment of these rights to third parties, are assigned.

12. LIABILITY
Without limiting in any way the rights recognized to the participants of this Contest and future contests by the provisions that are applicable, LV declines any responsibility for the loss or delay of any participation due to any interruption, temporary lack of availability or continuity of operation, transmission problem, loss of information, fraud, network failure, Software malfunction, access, communication or response failure or alteration of the Contest or future contests due to technical or other problems beyond its control or that are attributable to network operators, intermediary service providers or third parties.
The participants of this Contest and future contests, exonerate, in the broadest way that is legally appropriate and without limiting in any way their rights as consumers, LV for any type of liability, sanction, claim, lawsuit or civil, commercial, criminal, administrative, including compensation of any nature and/or nature, expenses or costs (with express inclusion of the fees of lawyers and solicitors).
Without limiting in any way the application of the guarantees and rights recognized in the applicable regulations, LV will not be responsible for the negligent or illegal use of the Prizes by the participants and does not assume any responsibility for any damage or harm of any kind that may suffer the winners, or third parties as a result of the use of the Prizes.
LV reserves the right to adopt corrective measures and to make those reasonable decisions that are necessary to solve the incidents that may arise during the course of the Contest, or future contests, to guarantee the correct development of the same, including the right to eliminate from the Contest or future contests, for justified cause to any user who defrauds, alters or disables the proper functioning and the normal and regulatory course of the same.

LV is exempt from any type of responsibility, from the moment in which the winners accept the Prizes. The winners may not take any type of legal action against LV for any reason derived from the Prize, its misuse, or as a consequence of the benefit of the Prize itself.
13. LAW AND JURISDICTION
These bases are governed by Spanish law. The participants accept that any controversies that may arise in the interpretation and execution of these bases will be subject to the jurisdiction of the courts and tribunals of the city of Barcelona, ​​unless, in accordance with the applicable regulations, other courts and tribunals are competent.
