The Criminal Chamber of the National Court (AN) has ratified the personation of two agents of the National Police as private prosecution in the case of Democratic Tsunami (TD). The police were injured during the incidents that took place in Urquinaona square in Barcelona on October 18, 2019 in protest of the sentence of the trial.

In an order made public this Friday, the magistrates deny the appeals presented by the Prosecutor’s Office of the National Court and the investigated Marta Molina and Oriol Soler, against this resolution.

The appellants alleged that the events by which the police officers were injured “are not the subject of investigation in this procedure.” In this sense, they recalled that Tsunami did not call the strike and only published a single message on Twitter supporting the call.

However, the Chamber alleged that the fact that Tsunami announced on its social networks the call for a general strike meant that “under the cover of this strike, serious alterations of social peace and public order occurred.” Therefore, he alleges that it is “evident” that the riots were part of the process under investigation and the two agents can appear as victims.

One of the agents received a blow to the head for which he had to be admitted to the ICU. Meanwhile, the other suffered a “serious injury” to the radius of his right arm while he was part of the operation that at that time contained the protesters.

“The imputation of the material result of the injuries and damages caused to TD is not gratuitous,” said the investigating judge of the García-Castellón case. “On the contrary, it is reinforced by the organization’s awareness of the danger that the tension that the organization was transmitting on the street at that time could pose,” he stressed.

Regarding this, García-Castellón referred to a conversation between the investigated Josep Campmajó and the former Catalan president Carles Puigdemont. In the dialogue, the politicians made direct reference to Tsunami as a tool to achieve independence. Likewise, they also spoke about the reaction of Catalan political leaders to the procés ruling.

“Yesterday I was on the front line again. Both in BCN and GRN. My people well distributed,” Campmajó told him. Furthermore, he added that: “Either you and Tsunami take control or we will have to start managing the price of casualties.”
