The Superior Court of Justice of Madrid (TSJM) has denied the precautionary measure that Ecologistas en Acción had requested to suspend the expansion works of Metro line 11 in the Madrid RÃo area to prevent the felling of trees, arguing that it does not materialize If this measure would paralyze all the works.
As reported this Thursday by the TSJM, the eighth section of the high court rejects the measure requested by Aedenat-Ecologistas en Acción to not carry out “the massive felling of trees within a unique green area” -the Arganzuela-Madrid RÃo Park and the Comillas Park – since according to ecologists it would cause “irreparable damage”.
The magistrates argue that the association “does not specify the damages that are impossible or difficult to repair” and specify that the requested suspension “would not limit its effects to the area to which the location of the Madrid RÃo station is reduced”, but rather “would extend them to the entirety of said work.
They highlight that when Ecologistas en Acción requests the precautionary suspension of these expansion works “it seems to reduce the affectation of the interest that it claims to defend, related to environmental values, to the avoidance of felling trees within the park, without having explained if the cessation of logging would necessarily lead to the cessation of all works”.
They definitively conclude that “the vague statements” of the applicants for the precautionary measure do not provide “certainty” of “what would be the precise purpose to be pursued with the requested precautionary measure”: to prevent the felling of certain trees in the Parque de la Arganzuela, or “discuss the location of the new Madrid RÃo station, which in its case, would exceed the mere protection of the trees to constitute a different procedural debate that would cover the urban issue.”
The Chamber has imposed the costs of the incident on the plaintiff.
Environmental and neighborhood associations have repeatedly expressed in recent months their opposition to the felling of hundreds of trees in the Madrid RÃo area to build a new Metro station.
