In order to drive a vehicle in Spain, not only is a driver’s license necessary, but it is also mandatory to have civil liability insurance with which to be covered in the event of an accident. The insurance companies will be in charge of assuming the costs when we have a mishap or a blow with our car.

Of course, this will always depend on different factors. One of them is the insurance coverage that we have contracted, whether or not it is fully comprehensive. On the other hand, there are the deductibles, which are amounts that the insured himself must assume in the event of a claim. When we suffer a traffic accident or have a problem with our vehicle, a common question is who is entitled to collect compensation. Compensation is the economic amount received by a person involved in an accident in which they have been the victim of damage. However, this does not mean that all those involved will receive it.

The person who will receive compensation for a traffic accident is the one who has suffered the damage through the fault of another, that is, when the culprit is the other driver involved. Once the accident has occurred, insurance companies must verify the damage and determine who was at fault for the mishap.

The next step will be to compensate the expenses derived from the accident, a responsibility that will fall on the insurance company of the person who was at fault for the accident. The injured victim must claim through his own insurance company to that of the culprit.

Once the compensation has been claimed, the insurance company has a few months to respond by means of a reasoned offer, agreeing to compensate the affected party. Or you can issue a reasoned response, justifying the reasons why you refuse to grant compensation. In the latter case, the alternative is to go to court.

When the company accepts to assume the expenses of the indemnity, these cover both personal and material damages. The amount of the amount will vary depending on the severity of the accident and the damages resulting from it, analyzing each particular case. For this reason, it is important that you collect as much information and evidence as possible, both at the time of the accident and for all mechanical repairs to the vehicle, medical services received by the injured and days off work resulting from the accident.

Likewise, it should be noted that the receipt of compensation is not immediate, but the insurer has up to three months to agree to assume the expenses. Once the granting of compensation has been agreed, the usual thing is to receive the amount in one or two months after discharge. Of course, the process would be prolonged in case of having to go to trial.
