ATLANTIC CITY– A Pennsylvania man has been charged with two counts of death by auto in connection with a head-on collision in Estelle Manor nearly two years ago, Acting Atlantic County Prosecutor Diane Ruberton said in a statement.

Albert Tolley, 63, of Malvern, was arrested Thursday in Cape May County by US Marshals and was being held in the Atlantic County Justice Facility pending a March 1 detention hearing.

On July 11, 2015, State Police responded to a crash on State Highway 49. According to investigators, Tolley crashed head-on into a vehicle driven by Karen Kunak, 71, of Dravosburg, Pa. Kunak’s husband Joseph, 72, who was a passenger, was killed in the crash, as was Tolley’s wife Suzanne, 61, who Nakitbahis was a passenger in Tolley’s vehicle.

An investigation by the prosecutor’s Fatal Collision Investigation Unit and the State Police determined that the crash occurred as Tolley was trying to improperly pass other vehicles. Ruberton authorized criminal charges against Tolley Jan. 18 and he was indicted by a grand jury Feb. 16.

In addition to the criminal charges, Tolley was issued motor-vehicle summonses for reckless driving, improper passing and failure to maintain a single lane.
