The Anti-Corruption Prosecutor’s Office has opposed the imputation of President Joan Laporta before the judge investigating the Negreira case, considering that his participation in the events in his first presidency (2003-2010) would already have prescribed.
After the complaint by the Prosecutor’s Office itself in March, the new complaint filed by Miguel A.P. He asked that Laporta be investigated, arguing that there was a “concert” for the purchase of referees among all the Barça boards since 2001 -including that of Joan Gaspart, for whom he also requests the imputation-, but the public ministry alleges not only the prescription of Laporta’s participation in the events, but also adds that, between 2003 and 2010, a period in which the current president could have ordered or tolerated payments to Negreira, there were no crimes of sports corruption or unfair administration, for which the defendants are being investigated so far. The Prosecutor’s decision reached Barça’s legal services yesterday, which are closely following the evolution of the case.
Before the complaint, the court has asked the rest of the parties to rule on the imputation request and the Prosecutor’s Office has spoken out against it, alleging that the events that occurred during the first presidency of Laporta, between 2003 and 2010, are prescribed and not they can be investigated.
The legislation in force in 2010 did not contemplate the criminal liability of a legal person either, which would be another way of imputing Laporta as the head of the club in its first stage.
However, the Prosecutor’s Office has positioned itself against the complaint filed by Miguel A.P. and asks the court not to investigate either Joan Laporta or Joan Gaspart for his actions in the events. In any case, it will be up to the examining magistrate to make the final decision about whether or not to investigate the presidents of Barça between 2001 and 2010.
