The Provincial Court of Alicante has suspended sine die by order of the Constitutional Court the repetition of the jury trial for the crime of the widow of the former president of the Caja de Ahorros del Mediterráneo, which was to be held between May 3 and 25, this year.

This is reflected in an order issued this Wednesday by the presiding magistrate of this Jury Court and that has already been notified to the parties involved in the procedure.

The magistrate of the Alicante Court has made this decision in application of a ruling issued yesterday, April 25, by the Constitutional Court, in which the precautionary suspension of the appointment of the oral trial is agreed within the framework of an appeal for amparo filed by the accused of the murder, Miguel López, who was the son-in-law of the victim.

This crime occurred on December 9, 2016 in a car dealership located in the city of Alicante. The Provincial Court held a first jury trial for these events in 2019 and acquitted the defendant after the verdict of not guilty issued by the popular jury.

The sentence was confirmed on appeal by the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community in March 2020.

However, in May of last year, the Criminal Chamber of the Supreme Court upheld an appeal filed by the private prosecution, which is exercised by a son of the deceased.

The Supreme Court annulled the acquittal and ordered a new trial to be held on the understanding that the appellant’s right to effective judicial protection had been violated due to the destruction of a record that included a first verdict of the popular jury.
