The events took place in Roquetas de Mar between September and October 2021, according to the ruling, which states that from Monday to Friday the woman subjected the boy to touching while his brothers slept. It was on October 26 of that same year when she also raped him.
The victim, with borderline intelligence and diagnosed with developmental and language disorders, an autism spectrum disorder and another attention deficit hyperactivity disorder, needs specialized psychological care after suffering these abuses.
The accused took care of her friend’s minor children when she was away from her home in Roquetas de Mar (Almería) for academic reasons. It was for two months, according to the ruling (from September to October 2021), when the woman abused her minor, 12 years old. She did it when the boy’s sister took a nap. The accused “seeked intimacy” with the victim, pulled down his pants and began to touch his genitals, something she repeated “almost every afternoon, from Monday to Friday.” Thus, until during the afternoon of October 26, after having smoked hashish, she undressed the child and, after acting as on previous occasions, she raped him.
“These behaviors have caused the minor emotional, physical and behavioral situations and symptoms compatible with them, recommending specialized psychological treatment,” the ruling states.
Due to these facts, the accused has been sentenced to four years and seven months in prison for a continuous crime of sexual assault with penetration of a minor under 16 years of age, for which a restraining order of 500 meters from the victim is also imposed. during six years.
The magistrates apply two mitigating circumstances in their case; the first, that of being under the effects of toxic substances since they believe that having smoked hashish affected in a “very slight way” his intellectual and volitional abilities, and that of psychic alteration, since he has been diagnosed with “slight mental retardation.” and a degree of disability of 36%.
She has also been disqualified from exercising parental authority, guardianship, conservatorship, guardianship or foster care for four years and from exercising any profession or trade, whether paid or unpaid, that involves regular and direct contact with minors for 10 years.
In addition, he has been placed on probation for five years from his release from prison, and has been ordered to pay compensation to the attacked minor of 10,000 euros.
