The leader of En Comú Podem and ex-deputy in Congress Jaume Asens has proposed reforming the crime of terrorism in the Penal Code as a “middle ground” between the positions of Junts and PSOE to derail the amnesty law.
The pro-independence party stopped yesterday in Congress the proposed law agreed with the PSOE, after justifying that it did not include all those prosecuted for the cases being investigated for terrorism in the National Court by Manuel García-Castellón and the Voloh by the judge of Barcelona Joaquín Aguirre.
Asens has assured that he understands the position of all parties, in an interview on TV3 this morning, where he stated that “what worries the PSOE most is that the law passes all the filters, that of the constitutional, that of Europe and opinion. public, and what worries Junts the most is that it covers all the defendants.”
The Sumar negotiator has highlighted that there is room for negotiation, in addition to “other solutions”, and has commented that “the law could have been approved, consolidated the position, and then moved forward with a new reform” despite the fact that Junts acted to prevent judges from “sabotaging” the application of the Amnesty.
“Putting the bandage before the wound can have its contradictions,” warned Asens, who has proposed a reform of the Penal Code on the crime of terrorism, which, according to the leader of the commons, is defined in a “very diffuse way and that It allows for many interpretations.”
In his opinion, the Penal Code “poses a very ambiguous definition where any action that is considered to violate the constitutional order can fall within the definition of terrorism,” Asens clarified. The Sumar negotiator has stressed that the case of Judge Manuel García-Castellón, who accuses those responsible for Tsunami Democràtic of terrorism, is based on “a degree of attempt that has not materialized”, and for this reason, Asens has pointed out that Another possibility would be to “include within the amnesty law, cases of terrorism where there is only attempt.”
In any case, Asens has described Junts’ refusal to approve the proposal as an “error”, and has assured that it turned the Government and its partners into a “laughing stock of the PP and Vox”. In the same sense, the leader of the commons has commented that he was concerned by the “satisfaction” faces of the opposition deputies and that, in his opinion, “García-Castellón has achieved one of his objectives, which is to divide the investiture block.”
Even so, Asens has stated that García-Castellón’s case “has its days numbered,” and has highlighted that “the prosecutor himself has said that it has no legal basis.” Regarding the Voloh case, the leader of the commons has described the cause as “fantastical” and that, in his opinion, “it will fall under its own weight.” “As a lawyer I have seen many cases that begin as treason and then deflate,” the former deputy stressed.
