New row in the Fiscal Council as a result of the new appointment of Dolores Delgado as prosecutor of the Democratic Memory and Human Rights room, a recently created position. The State Attorney General, Ãlvaro GarcÃa, has proposed his predecessor for the position despite having a majority against it, according to sources from the agency.
The six members of the conservative Association of Prosecutors, plus the representative of the minority APIF, have refused to vote on the appointment, considering that it is a “crude maneuver” to place Delgado before the general elections are held, called for July 23. In the event of an electoral turnaround, GarcÃa would be removed from his position.
The conservative association believes that the current attorney general, Delgado’s successor after her resignation for health reasons, intends to benefit her despite the fact that there are other more qualified candidates for the position. For example, Carlos Castresana, who works in the Office of the Prosecutor of the Court of Accounts and was the Spanish candidate for chief prosecutor of the International Criminal Court (ICC) in 2021, presented himself.
The attorney general decided to bring forward the plenary session of the Fiscal Council, scheduled for June 19, after learning of the early elections. For the majority, this movement had the objective of guaranteeing that the Government gives it time to carry out the appointment of Delgado before the elections.
The attorney general has come out in defense of his decision, alluding that Consuelo Madrigal made appointments with the dissolved courts when she was number 1 of the Prosecutor’s Office. Both the AF and the APIF have reproached GarcÃa for his attempt to “discredit” Madrigal and accuse him of using the official channels of the public ministry to do so.
In this scenario of tension, the two associations -which together achieve seven members of the total of 12 that make up the Fiscal Council- have accused GarcÃa of “institutional deterioration” to which he is subjecting the State Attorney General’s Office and for which they demand his resignation.
