The Investigative Court number 5 of Granada has agreed to the partial and free dismissal of the facts for which the former mayor of Maracena (Granada) Berta Linares and the former socialist councilor Antonio García were investigated as alleged inducers of the illegal detention of the former socialist councilor Vanesa Romero on February 21, 2023. The order decrees that only the case against Linares’ ex-partner continues, as the alleged material author of the illegal detention, two crimes of threats, a minor crime of injuries and a crime of injuries psychic.

The aforementioned resolution is not final and an appeal is possible against it, which may be filed in writing in court within five days following notification of the appealed order or the resolution of the appeal for reform. If an appeal for reform is filed prior to or together with the appeal, the deadline for filing it is three days following notification of the appealed order.

The accused allegedly gave her the excuse to get into her car that she had run out of gas and once inside the vehicle he threatened her with a gun that the Civil Guard has confirmed was simulated.

At one point, he tied the councilor with hand and foot ties, covered her head and forced her to get into the trunk of his vehicle, which he parked in a store in Armilla (Granada) before leaving. She managed to escape and ask for help, after which she reported the events to the Civil Guard and alluded to the existence of possible urban planning irregularities that could motivate what happened.

The Court of Granada already revoked in November 2023 the order by which a parallel investigation was opened for an alleged urban plot in the City Council of this town, understanding that the irregularities reported by the former socialist councilor Vanesa Romero are not corroborated in the documents seized following his kidnapping and that, therefore, the police conclusions are based on “mere suspicions” provided by his testimony.
