Five years and one day in prison for attempted murder. It is the penalty imposed by the Second Section of the Provincial Court of Valencia for a 21-year-old young man who tried to kill another whose throat was cut because he did not want to give him a cigarette.
The Chamber has established compensation of 15,210 euros for the victim for the injuries and sequelae derived from the assault, consisting of tiredness in one arm or the involuntary closing of one eye when working hard. The prisoner must also pay 3,765 euros to the Ministry of Health for health care for the victim.
In addition, the aggressor may not communicate with the injured party or come within 300 meters of him, his home, his place of work or any other place where he is, for a period of seven years.
The attempted murder occurred during the celebrations on the night of San Juan 2020, in the early morning of June 24, in a public park in the city of Valencia, when the victim was next to some bushes to cover up his partner. , who had hidden behind them to urinate. In this situation, the convicted person approached the victim to ask for a cigarette, but he told him to get away from him because his partner was urinating.
The defendant insisted, and upon the victim’s new request to move away, he smashed a balloon-type glass cup that he was holding in his hand against a palm tree and, in a single movement, cut him with a fragment on the right side of the neck. neck and left arm.
The attacker fled the scene, while the wounded man began to bleed profusely and his partner screamed for help. A police officer assisted him at first and gave him a tourniquet when he began to lose consciousness as a result of heavy bleeding.
The victim later underwent emergency surgery to repair an artery and a vein affected by the attack, which caused injuries that, according to the forensic report, were serious and would have caused his death if not treated.
The sentence is not final and an appeal can be filed against it before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
