The Civil Guard of the Region of Murcia has arrested a 17-year-old minor for causing a fatal traffic accident and fleeing the scene. The young man, who did not have the required driver’s license, was behind the wheel of a car with seven occupants, that is, two more than allowed. In fact, one of them -the one who was in the trunk- lost his life in the accident, registered on the RM-12, near Los Belones (Murcia).

Furthermore, when the perpetrator of the accident was identified and located hours later, he still returned a positive drug and alcohol test. Specifically, the breathalyzer marked 0.14 and 0.13 mg/l of exhaled air -the maximum rate allowed for minors of 0.0- and the test for prohibited substances indicated that he had consumed cannabis and amphetamines.

The detainee is allegedly responsible for the crimes of reckless homicide, abandoning the scene of the accident and driving without a license.

The incident occurred in the early hours of last Thursday, July 27, on the conventional dual carriageway RM-12, which joins the AP-7 with La Manga del Mar Menor, near Los Belones, in the municipality of Cartagena. Civil Guard agents went to the scene and verified in situ that the accident occurred when the car left the road to the left in a curved section and collided with the concrete median that separates the two carriageways. The force of the impact projected him against a metal security barrier on the opposite side and then he was thrown again against the concrete median on the left side in the Cartagena direction.

As we have indicated before, at the time of the accident, the car was occupied by seven people -all young-: six escaped unharmed, but the one in the luggage rack died. At first, it was not possible to determine who the driver of the damaged car was or the identity of two of the travelers who accompanied him, of whom it was found that they had left the place in a vehicle that stopped to help in the accident.

A few hours later, and as a result of the investigations carried out by the civil guards, they located the driver of the wrecked vehicle, who had apparently gone to his home. La Benemérita has recalled that the crime of homicide, in its modality of serious negligence committed using a motor vehicle or moped, included in the current Penal Code punishes with prison terms of 1 to 4 years and the deprivation of the right to drive vehicles at motor and mopeds for a period of more than 1 and up to 6 years.

The crime of driving a motor vehicle or moped without ever having obtained a driving permit or license is included in article 384 of the Penal Code, as a crime against road safety, punishable alternatively with prison sentences of 3 to 6 months. , fine from 12 to 24 months or work for the benefit of the community from 31 to 90 days.

For its part, the crime of abandoning the scene of the accident, punishable in article 382bis of the Penal Code, is punishable by imprisonment from six months to four years and deprivation of the right to drive motor vehicles and mopeds from one to four years. , to the driver who, voluntarily and without his own risk or that of a third party, leaves the place of the accident where one or more people were killed or seriously injured.

The Civil Guard has appealed to the public so that, as in this case, when they witness or are aware of a traffic accident, they take note of the greatest number of data possible, especially the people involved, type and characteristics of the vehicle, in particular its license plate and communicate it to the security forces, with the aim of facilitating the police investigation and preventing events such as these from going unpunished.
