The Supreme Court (TS) has dismissed the contentious appeal filed by the former deputy of the Parliament of Catalonia Pau Juvillà against the agreements of the Central Electoral Board (JEC) that declared the supervening ineligibility and, consequently, ordered the withdrawal of his act of deputy , at the request of the parties, Ciudadanos, the Popular Party and VOX.

The decision of the Supreme Court acquires special relevance now given that two Catalan parliamentary groups have requested that the Electoral Board rule on the ineligibility of Laura Borràs after the ruling of the Superior Court of Justice of Catalonia that convicted her of a crime of prevarication and document falsification.

The Supreme Court argues that “It has already been repeatedly declared that the application of the provisions of the Organic Law of the General Electoral Regime (LOREG) has an automatic effect for the criminally convicted.”

Former deputy Pau Juvillà, a CUP militant who was convicted of a crime of disobedience, requested that the JEC’s decision be annulled “for having hijacked sovereignty in Parliament” and “for having declared him ineligible in full exercise without giving him the process of hearing and while the Supreme Court had not yet dismissed the precautionary measures”.
