Two young men acquitted of inducing two minors to rape another in an apartment area

The Third Section of the Provincial Court of Valencia has acquitted two young people who are currently 24 and 26 years old of having induced, in July 2020, two other minors to rape another minor in an apartment area of ??l’Horta Nord. .

The minors were sentenced in July 2022, in another independent process, to two years of confinement, but they were not admitted because their sentence was commuted to the same period of supervised release.

The prosecutor and the private prosecution maintained in the trial that the sexual relationship into which the minors forced the victim – who was in a state of intoxication – occurred due to the behavior of the defendants, who encouraged the abusers (inducers), an extreme that the Chamber has not considered proven.

On the contrary, the court believes that it has not been proven that the accused went to the roof of the apartment building where the attack occurred, and that perhaps the victim’s memory is imprecise due to the consumption of alcohol in combination with other medications that took.

“We are not saying that the victim is lying, but rather that her memory could have been affected by the consumption of alcohol in combination with the medication that she was taking on the material date. In addition, she received information from outside when she spoke with her friends about the events, which They told him what was said by the urbanization about what had happened”, so “it is not easy to discriminate the internal memory from that contaminated by the information received from outside”, according to the sentence.

The events occurred on July 9, 2020 in an apartment area in a municipality of l’Horta Nord, when the victim was left with one of the minors.

The prosecutor initially demanded a sentence of 22 years in prison for each of the defendants as alleged perpetrators of two crimes of sexual abuse of a minor.
