Judge Arturo Zamarriego, head of the Court of Instruction 9 of Madrid, will seat Padilla in the dock for a series of comments he made in 2020 against the gender identity of Ruiz, who is a renowned human rights activist. of LGTBI people, especially the trans community.
The alleged crime against the dignity of the person due to their sexual identity is included in article 510 of the Spanish Penal Code. As stated in the code, this crime is punishable by a prison sentence of between one and four years. In this case, the Cybercrime Prosecutor’s Office has requested one year and nine months of deprivation of liberty for the Benidorm Prosecutor’s Office.
The aforementioned media has echoed the comedian’s request, who requests a total of six years in prison for Ylenia for the alleged crime against dignity, but also for the psychological injuries she suffers derived from said episode. In addition, the former Cuatro collaborator also requests compensation of 60,000 euros and a restraining order of one thousand meters.
The accusation includes in its complaint a series of insults towards the entire LGTBI community and, especially, towards Elsa, among which are: ”Trash”, ”Is that a woman?”, ”Shitty riffraff” ”, ”Sect”, ”Drug addicts”, ”Murderers”, ”Degenerates”, ”I mean Elso”, ”To me, you are a man. Maromo!”, ”Nature took its toll on you and you were born with a fucking dick”, etc. In addition, Padilla even threatened Ruiz: ”Let’s see if they’re going to bust you… my friends… okay?”
