For years the urban legend has spread that if the license plate, the model of the car or the name of the offender are misspelled, the fines become null and void. The truth is that anyone can appeal a traffic ticket, but for it to have greater prospects of prospering, it is necessary that some other circumstances exist.
Traffic agents can make mistakes when filling in the necessary fields to process an administrative sanction. These formal defects usually correspond to errors or omissions in the identification of the accused, the vehicle or the place, date and time that the event occurred. Other common errors may lie in the description of the offense that is the reason for the sanction or in the proper identification of the agent who signs the report.

Other palpable formal defects would be that the denounced fact was not properly detailed so as to associate it with the offense that was accused, or even that it did not coincide with a punishable offense in the Traffic regulations.
In cases where the license plate of the vehicle that appears in the photograph attached to the complaint is not that of the vehicle reported or cannot be unequivocally identified, the driver will have sufficient arguments to appeal it. There can be as many situations as there are traffic violations, so if you have doubts about the sanction that is charged to you, the ideal is to consult with an advisor before filing the appeal.
