As a result of the confession of the other two defendants in the case, who have indicated her as the alleged perpetrator of a crime related to corruption, all the groups in the Chamber, except Junts, have asked Laura Borràs to renounce her deputy act without waiting for the sentence. But if she doesn’t, the interim presidency of Parliament would only be undone when her seat was left vacant by court order.

? What would happen if Laura Borràs were disqualified by the TSJC?

In that case, she would lose her status as a deputy, but she could file an appeal before the Supreme Court.

? What would happen to your seat?

The disqualification by itself would not leave the seat vacant, unless the Central Electoral Board (JEC) so determines and designates the next one on the list.

?What would the JEC do?

The JEC has already ruled to withdraw the seat from Quim Torra and Pau Juvillà. Although in both cases the disqualification responded to electoral crimes and the accusation against Borràs is of a different nature, article 6.2 b of the organic law of the General Electoral Regime (Loreg), wielded then, would also serve for the president of Junts, who would be seen dispossessed of the record without waiting for the resolution of his appeal.

? What jurisprudence exists?

The Supreme Court declared the “supervening ineligibility” for those convicted to whom the aforementioned article of the Loreg applies, which refers to penalties of disqualification, even if the sentence is not final, “for crimes of rebellion, terrorism, against the public administration or against State institutions”.

Until the JEC acted, something it could do, as with Torra and Juvillà, at the request of a group from the Chamber, Borràs’s seat would not be vacant and the interim would continue.

If the JEC declared the seat vacant, it should automatically be filled by the next member on the Junts list, something that normally happens in the next plenary session.

? What would happen with the presidency of Parliament?

When the seat became vacant, so would the presidency, which would no longer be in office, and the plenary would elect a president.

? How is the new president chosen?

With the vacancy filled, the plenary would return to the starting point of the legislature and would have to vote for a new president. In the first vote, the candidate who obtained an absolute majority would be elected. Without an agreement between the groups, in the second round the one with the most votes would be elected president, which could lead to a tie between PSC and ERC.

? What would be done if there is a tie?

The Parliament’s regulation establishes that in the event of a tie in the second vote, the candidate of the group with the most seats will be elected, but ERC and PSC have the same number: 33 deputies. It would be an unprecedented situation, without a foreseen solution, and the lawyers would have to intervene to find a way out of this improbable blockade.
