The Pontevedra Court has sentenced an academy teacher from that Galician town to two years in prison who kissed one of his students, a minor under 15 years old, several times without her consent.
It is the second time that the court has had to issue this ruling, after the first of its rulings was annulled by the Superior Court of Justice of Galicia (TSXG).
The judges of the fourth section of the Court consider it proven that the teacher sent WhatsApp messages to the victim, including communications of sexual content.
In September 2019, according to the ruling, he waited for her with a jelly bean in his mouth, outside the academy elevator, “giving her a kiss on the mouth, without her consent.”
The judges assure that, on another occasion, he showed up at the minor’s home, offered her coffee and some sweets, grabbed her by the shoulders and, without her consent, kissed her on the mouth.
To these episodes we must add that, in November 2019, taking advantage of the fact that he was left alone with the victim at the academy, he held her face and, without her consent, also gave her two kisses on the mouth.
Furthermore, on another occasion, when the accused was going down in the elevator with the young woman, “he held her against the wall, and, against her will, kissed her on the mouth” and another day he took advantage of the fact that they were alone in the academy to enter in the classroom where the victim was and, surprisingly, kissed her on the mouth.
Apart from sentencing him to two years in prison as the perpetrator of a continuous sexual assault, the Pontevedra Court has disqualified him from working as a teacher for two years and has prohibited him from approaching the victim or communicating with her for three years.
The court has also disqualified him from any profession, trade or activities, whether paid or unpaid, that involves regular and direct contact with minors for seven years.
The ruling is not final, since there is an appeal against it before the Galician high court.
