The Provincial Court of Alicante has sentenced a man to 13 years and three months in prison for raping a woman after entering her house, in the city of Benidorm, through the balcony.

The Court considers him the author of a crime of sexual assault in conjunction with a crime of housebreaking. It also declares him the perpetrator of three other crimes of attempted burglary, since after committing the rape, on successive days, he tried to enter the victim’s home by the same procedure on up to three occasions.

The sentence was handed down after a popular jury issued a guilty verdict and establishes that the convicted person compensates the victim with 25,000 euros for the moral damages suffered.

According to the account of proven facts collected in the judicial resolution, the prisoner knew that the woman had reduced mobility because on September 29, 2021, he himself, along with a friend, had taken her home after having suffered a fall that It caused the fracture of the tibia and fibula.

With knowledge of this limitation, on November 12 of that same year, 2021, the man went to the injured party’s home, located on the second floor of a housing block in Benidorm, on the ground floor of which there is a restaurant with a uralite roof. Once there, he climbed to the roof of the bar and from there climbed the bars of the balconies until he reached the second floor and accessed the woman’s apartment through the glass window.

Once inside the house, he surprised the tenant in the kitchen, covered her mouth and dragged her to a room, where he sexually assaulted her. After that, she left the house through the main door after warning the victim that she would return.

The convicted man carried out this threat on three more occasions, on November 27 and on December 2 and 28 of the same year, when he climbed to the roof of the bar and climbed the façade of the property until he reached the bars of the balcony of the building. harmed

However, on none of these occasions did he manage to enter the home due to the woman’s cries for help or due to the intervention of a friend of hers who had moved into her house a few days before due to the situation of fear generated by the facts described above.

The Court has also imposed on the aggressor the measure of supervised release for eight years from the completion of the prison sentence, and special disqualification for any profession or trade that involves regular and direct contact with minors, whether paid or not. for 20 years. Likewise, you will not be able to get closer than 300 meters to the injured party or communicate with her by any means for a period of 21 years.

The sentence handed down by the Alicante Court is not final and can be appealed before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
