The defense of the soccer player Dani Alves returned to claim yesterday his provisional freedom before the Court of Barcelona using the argument that the transfer of his children to Spain avoids the risk of flight. An argument that the victim’s lawyer has come to describe as a “fictitious life project”.
The third room of the Court of Barcelona held a hearing yesterday with the presence of all the parties, in which the footballer’s provisional detention was reassessed after he requested his release for the last time in April and that the judge granted it to him. denied in May.
The footballer’s defense filed an appeal against said refusal before the hearing, and this summoned the parties yesterday, so that they could make their arguments, before making a decision that will certainly be announced next week.
The soccer player’s lawyer, Cristóbal Martell, used various arguments to demonstrate that there is no risk of flight, focusing on the registration of the defendant’s two sons, aged 15 and 17. A family decision that accredits “his will” to remain in Spain until the trial is held.
Martell referred to the images recorded by the nightclub’s security cameras that show a normal relationship between the two before entering the bathroom, which contradicts the climate of “terror” that the victim described in her court statement. A disparity that, in the opinion of the defense, “weakens” the credibility of the complainant’s account.
Martell also highlighted that his client maintains the headquarters of the company that manages his assets and audiovisual rights in Barcelona. And he provided documentation proving the dissolution of four of his companies in Brazil. “My client will not escape because he knows that there are elements to defend himself and because he is and feels from Barcelona,” he insisted.
Ester GarcÃÂa, the victim’s lawyer, questioned whether Alves’ children are already living in Barcelona as an argument to believe that he will not escape. The lawyer assured that the defendant’s life project is “fictitious.”
One of the objective elements that is playing against the release of the Brazilian right now is that the investigation is practically finished and the trial will be held before the end of the year.
The three magistrates of the Court of Barcelona will assess the different arguments, debate among themselves, and make a decision that will be communicated next week.
