Agricultural organizations intend to protest on Friday morning against the problems of the sector with a simultaneous cut of the A-7 and A-31 highways and other roads from three points in the province of Alicante: San Isidro, in the region of La Vega Baja, Villena (Alto Vinalopó) and Planes (El Comtat).
But the Fourth Section of the Contentious-Administrative Chamber confirmed on Thursday afternoon the decision of the Alicante Government Subdelegation to modify the itinerary of two of the protest tractor units, which planned to invade the A-7 and A highways. -31, and that they be diverted to secondary roads.
The Court understands that these administrative resolutions, adopted on February 9 and 12, respectively, are justified and are based on reports from the Civil Guard “that warn of the significant impact on road traffic that such demonstrations could cause, and even a possible cut, on both main roads, which support great traffic intensity”.
For the Court, in a ruling that does not allow appeal, “far from being an unmotivated or capricious decision, it is based on reasons perfectly protected by legislation and jurisprudence. In no way is it deprived of the exercise of the oft-repeated constitutional right, but simply introduces the alteration of the route intended by the promoters, without any loss of the very reason for being and foundation of the exercise of the right of assembly and demonstration,” the magistrates.
In this way, the Court rejects the appeals filed by the convening entity within the framework of a special procedure provided for in the Contentious-Administrative jurisdiction for the protection of the rights of assembly and demonstration.
The organizations ASAJA-Alicante, the Valencian Association of Farmers (AVA-ASAJA), THE UNIÓ Llauradora i Ramadera, the Peasant Coordinator of the Valencian Country (CCPV-COAG) and the Union of Small Farmers and Ranchers (UPA-PV), with the support of the Agro-alimentàries Cooperatives of the Valencian Community are the organizers of these three simultaneous protest events for tomorrow, Friday, February 16 in Alicante.
