The Supreme Court has upheld the appeals filed by the Association of Prosecutors and by a prosecutor who aspired to the same position and annuls the appointment of Eduardo Esteban as prosecutor of the Juvenile Chamber, proposed by Dolores Delgado when he was State Attorney General.

The Administrative Litigation Chamber of the Supreme Court has overturned his appointment for the second time after it was annulled the first time for lack of reasoning.

The Association of Prosecutors again appealed the appointment of Esteban Rincón.

The Chamber has once again agreed with the association, which demanded that the State Attorney General, now replaced by Álvaro García after his resignation, comply with the sentence handed down in April 2022 and order her to formulate a proposal to the Government to cover the position that “adjusts and respects the requirements imposed in the sentence”. They demanded that he annul the Royal Decree by which, once again, he promoted Esteban to the category of public prosecutor.
