According to the indictment, since July 2016 the woman, “moved by a contemptuous character towards her racial origin”, addressed on different occasions the family made up of a married couple and their two children who lived on the ground floor of the property where she had her home, “repeatedly” uttering humiliating expressions when she crossed paths with them.

In the opinion of the Prosecutor’s Office, said expressions, such as “Go to your country, you fucking Moor” were uttered “with evident offensive intent and contempt” for the dignity of the people to whom they were addressed. Specifically, on July 16, 2016, the accused, when she crossed paths with M. G. in the doorway, blurted out phrases like “you fucking moro, you bastard, you’re not coming in here, leave the crazy bitch in here, let her defend herself.” .

Likewise, around 8:00 p.m. on March 25, 2019, during the course of an argument, the accused punched A.H, G, T. in the face, when he was 17 years old, causing him a left orbital and malar trauma and a nasal contusion. Due to these facts, the accused was already convicted as the author of a minor crime of injuries, by means of a sentence handed down by the Court of Instruction No. 43 of Madrid.

In the month of April 2019, the accused again addressed M. G. and told him: “Shitty moro, filthy, asshole, crazy son of a bitch, bastard.” Similarly, on May 30, 2019, K. T. K. suffered an anxious-depressive attack after having a strong argument with the accused.

For his part, the couple’s son was attacked again on July 12 of that same year by M. A. M. M. after kicking him in his left ankle.

K. T. K. was diagnosed as a result of the events she suffered with an anxious-depressive adjustment disorder due to “the context of neighborhood conflict.” For her part, her daughter has suffered reactive anxiety due to the conflict with a neighbor.
