The jury finds Yaiza's mother guilty of the girl's murder

The popular jury has unanimously considered that the woman who killed her 4-year-old daughter in Sant Joan Despí (Baix Llobregat) in May 2021 is guilty of malicious murder without any defense or mitigation due to psychological alteration, but the collaboration with justice. Thus, the popular court accepts the majority of the theses of the Prosecutor’s Office and the private prosecution, which ensure that on the night of May 30 to 31 of that year the woman drugged her daughter with pills and the next morning she suffocated her and attempted to also commit suicide with pills. Both bodies were found by the grandmother in the afternoon, but the accused saved her life thanks to medical care. The accusations have kept the petition for permanent prison reviewable.

In the verdict, made public this Friday afternoon at the Barcelona Court, the jury unanimously considered that the accused repeatedly tried to return to her ex-partner, with whom she had broken up some time ago, as demonstrated by the statements of several witnesses, a letter that the woman wrote and some searches for voodoo rituals to recover partners. The father’s refusal to return to her “motivated a growing state of indignation, rage, sadness and frustration that materialized in the methodical planning of his daughter’s death and his own suicide with the aim of causing the greatest possible suffering” to the father and ex-partner. To do this, according to the jury, she searched the Internet for possible ways to kill, such as psychotropic drugs, and for known cases of vicarious violence.

They also take into account, due to the preparations, that the woman took out money and changed the name of her car to leave it with her parents, as well as the farewell letter she wrote for her parents and Sergio.

On the contrary, the jury unanimously considered unproven the transitory mental disorder or insurmountable fear, which the defense alleged as possible excuses for the sentence. Nor did they consider the outburst or obstinacy proven.

All evidence of the prosecution, such as witnesses, screenshots, messages and forensic reports, have been validated by members of the people’s court. Although a private psychologist hired by the defense tried to allege depression, anxiety and certain delusions on the part of the accused due to fear of losing her daughter to the girl’s father’s new partner, the jury remembers that the woman did not ask for legal help or psychological, nor to their family or friends.

However, they take into account that the woman “meticulously” prepared the crime for months, without having any psychiatric history. Furthermore, in the days before and on the day of the crime, she maintained a normal attitude. When she had already killed her daughter, she sent emails, she notified work and school that she and her daughter would not be going and she went to walk the dog.
