The defenses of the six detained for the murder of two civil guards in the port of Barbate (Cádiz), on February 9, presented this Thursday, after the Civil Guard report that no longer considers them material authors of the deaths, a written request for release before the Barbate investigating court handling the case.
Judicial sources reported that these requests occur after investigators from the central operational unit (UCO) of the armed institute and the judicial police of the Cádiz Command have determined that the drug boat piloted by Francisco Javier M. P., Kiko el Cabra, It was not the one that attacked and killed the agents in that Cadiz port.
It is worth remembering that one of the defense lawyers, Manuel Manzaneque, already stated this Wednesday, after learning of the UCO report, that “the only thing we hope is for our clients to be released, because they have been enduring denigration and opprobrium for quite some time.” of being falsely accused of murders they had not committed.”
For its part, the Prosecutor’s Office announced that it will ask that the six detainees remain in prison because, although they can no longer be considered material authors of the death of the two Civil Guard agents, they are accused of drug trafficking crimes, as explained this Thursday the Anti-Drug Prosecutor of Andalusia, Ana Villagómez. Such crimes are punishable by penalties that can reach seven years in prison, so the prosecutor does not consider that the precautionary prison measures adopted should be varied. The withdrawal of these measures was already requested by the defenses of those, until now, imprisoned on April 6, a request that the judge rejected.
The general director of the Civil Guard, Leonardo Marcos, spoke in terms similar to those of the Anti-Drug Prosecutor, who defended the investigation of the case that led to the arrest of these six people – who later the UCO report made clear that they are not the material authors -, and assured that “they did not act hastily” and that “not only does it involve the murder of two civil guards and the serious injuries of four others, but there are also crimes of smuggling, criminal organization, and it is a “very complex and dynamic research to which many efforts are being dedicated.”
Precisely, this Thursday it was confirmed that the four agents who survived the drug boat attack will testify this Friday in the investigative court of the Cadiz town as witnesses.
