A popular jury has declared this Wednesday not guilty of a crime of trespassing to the man accused of entering someone else’s home to take a shower after suffering stomach problems while walking through the old town of Malaga.
The members of the jury have declared him not guilty by seven votes in favor and two against, according to what the defense lawyer, Juan Carlos Alcázar Sánchez, has informed EFE.
The defendant, a British national and to whom the prosecutor was asking for a year in prison, assured during his statement that he had a very strong stomach ache and became ill and when he saw a woman in a doorway he asked if he could come in and he understood that authorized him.
His defense lawyer has always maintained that his client never entered without authorization, that he thought that the owner had authorized him to enter and that surely due to the language they did not understand each other.
During the trial, the prosecutor maintained that the defendant entered the house without the consent of the woman at around 3:30 a.m. on October 15, 2021, after suffering a stomach problem.
When passing a building located on Beatas street, he entered a portal, went up to the first floor and found the door of 1st A ajar, where its owner had been absent momentarily.
The investigated person went to the property, searched several closets in search of clothes to clean up and went to the bathroom to take a shower, at which time the woman returned to her home and noticed the presence of a stranger in the house, always according to the prosecutor’s version.
