The coroner of the Institute of Legal Medicine of Seville has issued a report in which she advises against the imprisonment of the former president of the Junta de Andalucía, José Antonio Griñán, sentenced to six years for the ERE case, since he is afflicted with ” a very serious disease with incurable conditions”.

The report is the coroner’s response to the request that the Court of Seville made last Tuesday to the Institute of Legal Medicine to specify its opinion regarding the admission to prison of Griñán, sentenced to six years in prison, and who suffers from cancer of prostate.

The coroner has analyzed the last medical report provided by Griñán, dated June 6, and concludes that despite having completed the radiotherapy treatment, the cancer has not remitted and that “periodic check-ups” and treatments that may make remission possible are mandatory. of the disease, although he insists that it is “incurable”.

The report signed by the coroner points out that it must be taken into account that “only a few months have passed” since Griñán was diagnosed with cancer in December 2022.

At present, he continues, “there are no medical criteria that allow us to talk about remission of the cancer he suffers from, so we are dealing with an incurable disease.”

He explains that not all cancerous processes are the same and that the therapies are very well tolerated by some people and not by others, for which reason he insists on what he already noted in the report he issued on May 24 about the need to carry out a study. individualized for each patient.

In the case of Griñán, it indicates that “although some of the secondary symptoms have improved, others persist and require periodic control with frequent releases. Generalized asthenia, in addition to other symptoms, once again makes clear the difficulty of maintaining a prison dynamic.”

He also recalls that the prison itself recorded in a letter the problems posed by the continuous transfers of prisoners to the hospital for consultations and outsourced treatments.

“It is not only necessary medical care in prison, but to avoid, among other things, the danger of infections in people with a depressed immune system and who can pose vital risks due to age (77 years) and due to the disease itself,” says the report. .

Regarding the warning that the court made to the Institute of Legal Medicine that “it was not appropriate” to request documentation of each of the reviews that were made to Griñán, the forensic responds that she only requested the result of the review that was scheduled for 6 June because it was “an essential review” after completion of radiotherapy.

The First Section of the Hearing, which handles the case, has forwarded the coroner’s report to the Prosecutor’s Office and the private prosecution and has given them a period of two days to inform them of the origin of the suspension of the execution of the sentence from prison.

Former President Griñán is the only one of the former high-ranking officials of the Junta sentenced to prison who remains free and is pending, like other convicts, the resolution of the Constitutional Court on the appeals they presented.

The second chamber of the court of guarantees endorsed studying the protections presented by twelve of the 15 former senior socialist officials of the Board, but rejected the very precautionary measures of suspension of admission to prison requested by Griñán and by the counselor Antonio Fernández, although it has agreed the opening of a separate room to study individual requests.
