The State Attorney General’s Office is already preparing the ground for the future approval of the amnesty law for those prosecuted by the process. The Attorney General, Álvaro Órtiz, has asked the Prosecutor’s Offices of the Supreme Court, the National Court and that of Catalonia – tribunals in which cases related to the independence challenge have been investigated – to send “detailed” information about those procedures that may be be affected by the measure of grace. He gives them until December 14, a date on which the new law will continue in parliamentary process, pending approval.

The “detailed, individualized and systematized” information requested by the Attorney General’s Office has to do with all the summaries that are in progress, that have been filed or on which a sentence has already been imposed. As long as they are between January 2012 and November 2023; the two dates with which the amnesty is limited in the bill, which could still be modified during its parliamentary journey.

In the letter, the Technical Secretariat justifies this movement to collect information in the “complexity of the matter” and the short period established by the norm to make the amnesty effective: two months. For this reason, he emphasizes that it is “urgent and preferential.” Furthermore, he claims to act “in order to fulfill the constitutional mission of the Public Prosecutor’s Office through the principle of unity of action that governs our institution.”

The Prosecutor’s Office makes special mention of the compilation of information on the events that have to do with the consultations of November 9, 2014 and October 1, 2017; both its preparation and consequences, as long as they are limited in time by the period included in the future standard.

For all this, the president of the ‘popular’ has stated that “unfortunately” the PP has to “conclude” that the behavior of the State Attorney General “is very similar to that of a member of the Council of Ministers.”
