A 37-year-old man has been sentenced by the Alicante Court to pay a fine of 2,160 euros for attacking a young woman and touching her breasts in the middle of the street, in the municipality of San Vicente del Raspeig.
The court considers him the author of these events and applies the mitigating circumstance of reparation for the damage, since the defendant had deposited the amount of 1,000 euros with the purpose of covering possible liabilities before the trial took place.
In fact, the defendant expressed his agreement with the terms of the accusation formulated by the Prosecutor’s Office at the beginning of the hearing, so, after the recognition of the facts, its continuation was not necessary.
The event occurred around 5:00 p.m. on August 28, 2022 at the intersection between Alicante and Poeta García Lorca streets, in the Alicante town of San Vicente del Raspeig. The sentence specifies that the accused approached a young woman who was walking at that intersection and greeted her with a “hello.”
He then lunged at her and grabbed her breasts, touching them over her clothes while trying to pull down the top she was wearing. At that moment a struggle began between the two until the victim was able to flee the scene and came to file a complaint.
Once the authorship is admitted, the court imposes on the defendant a fine of 18 months at a rate of 4 euros per day, in addition to the measure of removal at a minimum distance of 500 meters from the victim for a period of three years. Finally, it establishes that he must pay compensation to the injured party in the amount of 1,000 euros.
The defendant had already been tried and convicted previously for the crime of indecent exposure and sexual provocation of a minor under 16 years of age and ordered to pay an 8-month fine.
