The head of the Court of First Instance and Instruction number 3 of Ceuta has concluded the proceedings he has been directing since May 2022 on the behavior of the former Health Minister of the City Government, Javier Guerrero, then in the PP, and has proposed taking him to oral trial as the alleged perpetrator of three alleged crimes of a sexual nature against more than half a dozen especially vulnerable unaccompanied foreign minors.
The magistrate understands, as legal sources have explained in statements to Europa Press, that there are “rational indications” in the case to try the doctor for a continued crime of sexual assault in relation to the subtype aggravated by being committed on minors under 16 years of age and another for communication with children of that age for sexual purposes.
The judge has given the Public Prosecutor’s Office and the private prosecution ten days to request the opening of an oral trial, the dismissal of the case or the carrying out of additional proceedings. Both parties have presented appeals for reform and, subsidiarily, appeals, so that the investigation remains open until the Civil Guard analyzes all the electronic devices seized on the doctor on January 11, 2023, when he was detained at his home.
Guerrero would face requests for a sentence of up to nine years in prison through the abbreviated procedure. The former counselor remained in provisional prison from January 13, 2023 until the end of November last year, when it was agreed that he would be released without a passport on bail of 100,000 euros with the prohibition of approaching less than 200 meters from any unaccompanied migrant child. in Ceuta or on the peninsula.
The defendant served as Health Minister of the Government of Ceuta since the 2019 elections, which he participated in with the PP, until January 2021, when he was forced to resign after skipping the vaccination protocols against the coronavirus disease along with the rest. of senior officials in his department, something he did even though he said he did not like “punctures.” Months later he left the Popular Party and founded Ceuta Avanza.
In May 2022, the City’s Child Protection Service alerted the Prosecutor’s Office of inappropriate behavior by the doctor with unaccompanied foreign minors under his protection. The Public Ministry, in turn, placed the matter in the hands of the Civil Guard under judicial protection. The Benemérita Judicial Police Organic Unit investigated him for more than half a year until his arrest and subsequent imprisonment.
The former counselor is also listed as being investigated in another case for conspiracy to commit injuries after being heard by agents of the Armed Institute planning to send “a message” in the form of a beating to those responsible for the La Esperanza Shelter.
He has also been denounced for insults and slander after saying, in September 2022, that there was a conspiracy against him to prevent him from running with his party in the 2023 elections within the framework of which minors were “coerced” to to testify against him, a case that has already been filed twice by another judge.
