Jack Teixeira, a member of the Massachusetts Air National Guard, appeared in court on Friday to face charges of violating military law by the U.S. Air Force. The 22-year-old is accused of leaking sensitive U.S. national security materials online. Teixeira decided to delay entering a plea for the charges of obstructing justice and disobeying a court order until his court-martial trial, which is scheduled to begin on March 10th.

Teixeira had previously pleaded guilty to different charges in federal court in March, but the Air Force initiated an investigation in May into allegations of military law violations. Prosecutors claim that Teixeira obstructed justice by getting rid of electronic devices like an iPad, computer hard drive, and iPhone after the leaks were discovered, as well as instructing someone to delete his online messages. Additionally, he allegedly ignored an order to stop accessing classified information unrelated to his duties.

During the recent hearing, Military Judge Colonel Vicki Marcus announced that she would consider defense attorneys’ pre-trial motions in November and January. The defense is arguing that Teixeira’s right to avoid double jeopardy is being violated by the military charges. Teixeira was arrested in April 2013 after authorities accused him of committing a significant breach of U.S. national security while working in cyber defense operations.

Prosecutors claim that in January 2022, Teixeira, a lower-ranking airman with a top-secret security clearance, accessed hundreds of sensitive documents related to topics such as Russia’s invasion of Ukraine. They allege that Teixeira shared this classified information on the messaging app Discord in private servers, where he reportedly bragged about having access to information on various countries. The U.S. Department of Justice plans to seek a sentence longer than 16 years when Teixeira is sentenced on November 12th.
