The television presenter Mariló Montero requests 6 years in prison and compensation of 265,000 euros to two paparazzi for the crime of revealing secrets, for having photographed her topless on the terrace of a hotel in Bora Bora, during the Easter holidays in 2015.
In the third section of the Provincial Court of Barcelona, ??the trial began this morning against both paparazzi, Diego A. and Gustavo G., whom the Prosecutor’s Office exculpates from criminal responsibility because it considers that there is no crime in the conduct of the accused, but in any case they can be claimed compensation by civil means.
In fact, a Madrid court has already sentenced the paparazzi society, Diegus S.L., to indemnify the television journalist with 265,000 euros for unlawful interference with her right to honor, but the Court annulled the sentence pending the the criminal case opened in Barcelona is resolved.
The trial, which will continue with a second session next January, began this Thursday at the Barcelona Court with the preliminary issues raised by the prosecution and the defenses.
During the previous questions, the defense of the paparazzi has revealed that the private prosecution is returning to claim an amount that the court of first instance 35 of Madrid had already sentenced them to pay, an argument to which the Prosecutor’s Office has adhered.
The judgment of the first instance court in Madrid ordered the paparazzi to pay 265,000 euros to Montero, the same amount that the presenter requests as compensation through criminal proceedings, and 90,000 euros of that sum is due to the false information that they allegedly disseminated about the Montero’s sexual condition.
The hearing against the paparazzi will continue from January 23 to 26, 2024, after the court has rejected the request for annulment that the defense had raised, arguing that the Barcelona Court has no jurisdiction to prosecute these facts.
Although the complaint was filed in Madrid and the headquarters of the paparazzi company, Diegus S.L. is domiciled in Marbella, the magazine to which these photos were marketed, Lecturas, is located in Barcelona.
