The Ministry of Health of the Community of Madrid maintains more than a hundred professionals from the Madrid Health Service (SERMAS) without adapting the position to their conditions of disability, according to CCOO in a statement. Some of them are on sick leave as they cannot perform their duties.
These professionals took their place at the beginning of the summer, after an opposition in 2017, but as they have disabilities they have to offer them positions that are appropriate to their possibilities, as stated in the regulations.
Some have a disability of 33%, but others can reach up to 65%. And the problem is that many of them cannot take weights or cannot be in certain hospital units due to their own illnesses, since their injuries would be aggravated.
CCOO is aware, at least, that this violation is occurring in the Gregorio Marañón, La Paz, Cruz Roja and Fuenlabrada hospitals. Gregorio Marañón takes the cake in this type of non-compliance, since the non-adapted jobs that have been accumulating in the takeovers of the positions of the last oppositions, exceed seventy.
In La Paz and the Hospital de la Cruz Roja there have also been breaches with various professionals. At the Red Cross, two nurses without adaptation are on leave due to aggravation of their injuries.
And in the Fuenlabrada Hospital, which after the last opposition, ten people joined for the disability shift, this situation is also repeated. In this last case, CCOO worked so that after their incorporation they adapted the position correctly and they did so. But when mobility arose to obtain a permanent position, the problems began. Specifically, in the TCAE category (Nursing Auxiliary Care Technician) there are three professionals who are on leave due to aggravation of their injuries. The levels of disability of these three people range from 33 to 37%.
CCOO Sanidad Madrid denounced last June before the Labor Inspectorate several cases of professionals whose job adaptation was not attended to, although they took possession of their position with the mandatory report so that this legal requirement was met.
The person in charge of Occupational Health at CCOO Sanidad Madrid, Manuel Barroso, explains: “We have denounced the inadequacy of working conditions to the health problems presented by these professionals, whose medical recommendations and limitations are known by hospital managers.”
The regulations on occupational risk prevention establish that “these professionals will not be employed in those jobs because of their personal characteristics, biological state or physical, mental or sensory disability that may put their health at risk”, argues the person in charge of occupational health .
CCOO requests the immediate convocation of the Central Occupational Health Commission, dependent on the Ministry of Health, which has not met since February 1, 2023, to address these non-compliances, among other issues.
