The general secretary of JuntsxCat, Jordi Turull, warned this Thursday that the judges who do not apply the amnesty to all those affected by causes derived from the process, including Carles Puigdemont, investigated for terrorism in the Supreme Court for Tsunami Democràtic, will be prevaricating, in light of the changes introduced in the bill that this Thursday will see the green light in the justice commission of the Congress of Deputies after having incorporated a transactional amendment from the PSOE, Junts and ERC.
In essence, the rule approved today excludes terrorism and high treason from criminal oblivion as defined by the European institutions and not the Spanish Penal Code with the objective precisely of circumventing the movements of judges who investigate or may investigate terrorism. or high treason to some of those affected, such as Puigdemont himself.
In an interview in El Món with RAC1, the post-convergent leader has indicated that according to the law, which could come into force in mid-May and that the judges will have two months to apply, Puigdemont, Marta Rovira, Toni Comín or Lluís Puig should be able to Return to Spain in summer. “If a judge prevents it, he would be prevaricating,” he warned.
Junts’ spokesperson in the Lower House, Miriam Nogueras, spoke along the same lines at the doors of Congress, and gave more details of the agreement. “It is a comprehensive law that includes everyone and is immediately applicable,” said Nogueras, emphasizing the demand they had maintained since January.
Nogueras has insisted on warning the judges: “We will see if there is any judge who prefers to prevaricate rather than apply this law,” Nogueras added. For the post-convergent spokesperson, the changes to the law “nip at the root the possibility that the Spanish judicial leadership goes too far in its fabrication.”
For his part, Turull has taken the opportunity to highlight his party’s refusal to approve the law at the end of January, which has ultimately made it possible to incorporate the recommendations of the Venice commission that were known last week and that will allow, his trial, shield the law before the Constitutional Court and European justice “if it is admitted.” “If the law has been able to improve in relation to the Venice Commission, it is because there was someone who voted no to a ruling because they saw that the problem was not with the judge, but could be in the law,” argued Turull, who He has insisted that “now the problem may be with a judge who prevaricates.” And, as Nogueras later justified, “when Junts votes no, it means they have reasons to vote no.”
Both leaders have also made it clear that the amnesty and the general budgets of the State are different folders and that the agreement for the former does not presuppose the latter, although Turull himself has acknowledged that “the climate is much more favorable.” “If there had not been an amnesty, everything would have blown up,” admitted the leader of Junts, for whom “the climate helps much more to build an agreement” for the accounts.
Regarding the negotiations in recent days for the amnesty, Turull has revealed that while at first the negotiations were theirs with the PSOE and ERC with the PSOE, in the end they asked the socialists if they would accept an agreement between the two pro-independence forces. , which ultimately allowed the agreement between the three parties.
