The judge of the National Court Manuel García-Castellón has started a search for the deputy for ERC Ruben Wagensberg after learning from the media that he has gone to Switzerland due to the pressure of the legal case of the Democratic Tsunami.

Wagensberg left Spain last week and moved to Switzerland to protect himself from the case. The deputy in the Parliament of Catalonia is in Geneva to seek advice from organizations and lawyers that will help him in his case.

In a car, the instructor has asked the Civil Guard to locate Wagensberg, who could be in Switzerland. According to the magistrate, the deputy, investigated for terrorism for the actions of the Tsunami Democràtic platform, could have left the national territory and could be somewhere in the Swiss Confederation.

“Since one of the purposes of the investigation phase is to secure the persons responsible for the criminal acts investigated, determine the location of Wagensberg and ensure his availability to the investigation body, it is a relevant fact for the purposes of the investigation summary,” he warns in the resolution.

For this reason, it demands that the Civil Guard confirm whether the deputy has “evaded judicial action” and whether he has abandoned his usual home and work.

On the other hand, the magistrate responds to the Prosecutor’s Office that this matter, in which the riots promoted by TD are investigated in response to the process sentence handed down by the Supreme Court in October 2019, has been handled from the beginning as a case of terrorism.

In this way, García-Castellón responds to the attacks against his decision to pursue the case for terrorism, against the criteria of the Prosecutor’s Office. As he recalls, the Prosecutor’s Office already said in 2019 that the events investigated could be classified as a crime of terrorism.

Another thing is that recently the public ministry has positioned itself against this crime. The prosecutor in the case Miguel Ángel Carballo has already appealed several resolutions of the instructor, both for the crime and for the accusation of former Catalan president Carles Puigdemont.

This issue has generated so much controversy due to the scope of the amnesty law. Junts overturned the approval of the law in the Congress of Deputies because it seeks to amnesty all cases of terrorism linked to the process with an obvious focus on this matter. However, the PSOE has not wanted to give in to the signs of unconstitutionality.

In fact, the Supreme Court prosecutor has also reported against the Criminal Chamber, chaired by Manuel Marchena, assuming the investigation, as requested by García-Castellón, understanding that there are no clear indications against the leader of Junts. and not the crime of terrorism. In his report, pending assessment by the board of prosecutors, he points to possible crimes of public disorder and damage.

While the reasoned statement sent by the instructor to the high court is being resolved, it continues to carry out proceedings. The last has been this extension of the rogatory commission. In addition to locating the Republican deputy, he has also ordered to collect information from the Spanish Aviation Safety Agency regarding the events that occurred in El Prat in October 2019 and report them to the International Civil Aviation Organization (ICAO) so that it can certify if any action has been taken in this regard.

He explains that both in the letters rogatory sent to Switzerland in December of that year, or the one sent to the United States, the crime of terrorism was already expressly mentioned.

On the other hand, it also agrees to expand the rogatory commission to include the International Convention for the Suppression of the Financing of Terrorism formalized in New York on December 9, 1999 and which was ratified by Spain and Switzerland.

Regarding the rogatory commission to Switzerland, the objective was to locate the general secretary of ERC, Marta Rovira, and the data of an account number of a banking entity, CIM Banque Privée. The essential purpose of the commission is to investigate the financing that the TD organization was able to receive to materialize its actions.
