Evicted from his parents' house at the age of 40: with a job, without providing help and with an aggressive nature

Two retirees from Zaragoza filed a complaint to try to evict their 40-year-old son – with stable employment and the possibility of becoming independent – from their home due to their son’s aggressive nature and his refusal to provide financial compensation when they asked for help. The head of the Court of First Instance No. 19 of Zaragoza has agreed with them and has ordered the man to vacate his parents’ house in the Aragonese capital.

The retired couple specifically alleged that living with their son was “unsustainable” due to his aggressive nature and the threats he made against them. The parents also argued before the judge that at 40 years old, his son had a permanent and stable job and that he was capable of taking care of himself to acquire his own home, without needing to occupy his parents’ home.

In its ruling, reported by EFE, the court upholds all of the allegations raised by the parents in their civil lawsuit against their son, whom they repeatedly urged to voluntarily leave the home without success.

In his resolution, the magistrate appreciates the reasons for the marriage and discards the argument put forward by the defendant when he understands that the family relationship with his parents does not give him the right to use the home, which is why he condemns him to “free “empty and expeditious” the home.

The retired couple previously presented, in May of last year, a complaint to the National Police about the situation of abuse they faced, including a daughter who was not allowed to sleep with their noise, and the fear they had of being victims of an attack.
