The Government Council of La Rioja agreed on Tuesday to compensate 850,000 euros to one of the two young women exchanged at the former San Millán Hospital in Logroño when they were born in 2002, just as it already agreed with the other in October 2022. To this amount adds another 590,000 euros for the father who raised this young woman and 145,000 for the one she considered her brother, who had also requested compensation in this procedure, as detailed by the spokesperson for the Government of La Rioja, Alfonso Domínguez, in a conference briefing after the Council.
These amounts are included in the resolution of the administrative procedure for patrimonial responsibility, authorized by the Government Council in the case of exchanged babies. These amounts will be notified in the coming days to the interested parties and to the insurer of the Health Department of the Government of La Rioja, Domínguez detailed.
With this agreement, he stressed, the regional government has followed the line contained in the opinion of the Advisory Council in this procedure. The compensation to this young woman, as the main victim, has indicated, is similar to the resolution of the Rioja Executive in the first procedure opened in this community to the other young woman exchanged, to which it was agreed, in a Government Council of October 2022 , compensate with 850,000 euros.
The Government of La Rioja recognizes that there has been a financial responsibility of the Public Administration for the moral damage caused, which is not compensable, but which complies with the established legal procedures.
The case became publicly known in 2021, after in 2017 the grandmother of one of the young women, who was the first to be compensated, filed a claim for support against the person she believed to be the girl’s father, who rejected the payment. A judge ordered a DNA test on this man, which showed that he was not the biological father of the minor, and it was later proven that the person she considered her biological mother was not either.
This minor began the procedures to know her real parents and it was found that she was exchanged in the cribs for another baby who was born the same day as her at the San Millán Hospital in the capital of Rioja, which has since disappeared.
