Carles Puigdemont’s lawyer, Gonzalo Boye, sees his client protected in the Democratic Tsunami case being instructed by the judge of the National Court Manuel García-Castellón, but not “the other 70” accused in a process that yesterday experienced a new chapter when the board of prosecutors of the Supreme Court overturned the report of the prosecutor who did not find a crime of terrorism in the protests organized by this platform after the sentencing of the process in October 2019.
“I am not worried at all. There is no one with more armored defenses than Mr. Puigdemont. It is not a personal case. I am worried about the other seventy people,” the lawyer acknowledged in statements to El Món to RAC1. Boye has also admitted that the decision of the prosecutors was already expected, since, as he recalled, they are the same ones who supported the accusation of rebellion and coup d’état against the leaders of the process, in reference to Consuelo Madrigal or Fidel Cadena, among them. others. From there “anything is admissible,” Boye denounced.
In this sense, the lawyer recalled that Puigdemont has been investigated for rebellion, for sedition, now for embezzlement and they want to investigate him for terrorism and treason, to conclude that “beyond the Pyrenees no one believes anything anymore, “This is for internal consumption of a very specific parish.”
However, he has been upset by the meeting “to call it politely” of the board of prosecutors for which he has considered that “there is no legal support.” “The reports are normally made by a prosecutor; I do not understand why it should go through a body that does not legally exist or why there has to be another report and a disavowal from the prosecutor,” lamented the lawyer, who has warned that “people do not understands it, but neither do jurists.”
Once the report against prosecuting the Tsunami for terrorism is overturned, the issue will be in the hands of the lieutenant prosecutor of the Supreme Court, Maria Ángeles Sánchez Conde, appointed by the previous attorney general of the State, Dolores Delgado, but without a date for its delivery. In this regard, Boye has indicated that the date “we will know approximately the day they want.”
Boye has explained that the admissions chamber of the Supreme Court will have to issue a resolution and from there various scenarios will open up. The lawyer has indicated that the Supreme Court can say that it is terrorism and keep the case; also that they only stay with Puigdemont’s case because they say that he is the only one authorized, they may respect the rulings of the Court of Justice and return the cases because they are not the competent body. “Or the last one, which I think is what is going to happen, which is that they will say that they see terrorism there, but they are not clear about the links with Puigdemont. Puigdemont’s lawyer has also spoken about the situation of ERC deputy Rubén Wagensberg, investigated in the case, who last week it was learned that he is in Switzerland preparing his defense and treating the mental health problems derived from it. In this sense, Boye has reproached García-Castellón for trying to locate him. “Most of the case is built based on the media, it is a very clear case of lawfare,” Boye denounced. “I don’t know why we are spending public money to find out where someone is who is not even summoned to testify,” he added.
