The four minors accused of gang raping two 12-year-old girls in May 2022 in Burjassot (Valencia) have reached an agreement before the trial, according to which two of them accept sentences of three and four years of confinement, while the two others assume five years of supervised release.
This was agreed upon by the parties this Monday, when the oral hearing for these events was about to begin, in which there was a fifth person involved who has not been tried because he was under 14 years old – the minimum age to be criminally responsible – when it was committed. this sexual assault.
The Juvenile Prosecutor’s Office requested five years of closed confinement for three of the four accused minors and six years for the fourth, and demanded that the four receive sexual and equality education, as well as that they be prohibited from approaching or communicating with the victims. for two years.
Finally, the agreement reached, which the lawyers reported at the end of the hearing, contemplates three and four years of confinement for two of the accused, and five years of supervised release for the other two.
Likewise, the four will have to pay 10,000 euros each in civil liability, amounts that all of them have already deposited, in the absence of a small amount from one of them.
In addition, restraining orders for victims of five and three years are imposed on them, as well as the obligation to attend sexual education and equality courses.
Manuel Quijano, lawyer for one of the accused, has reported on these agreements and has stated that this episode has been “traumatic for everyone.”
For her part, Isabel Carricondo, lawyer for one of the victims, has also reported on the agreements reached, and has stated that both the victim she represents and her mother and herself are satisfied.
“Every victim needs a penalty or measure to be imposed because they need to know that the person who caused them harm is serving a punishment,” he explained, and also highlighted the importance of financially compensating victims.
In this regard, he has indicated that the majority of victims of sexual assault need psychological treatments, which are long and expensive, so, in his opinion, the only way for them to feel compensated is not only with punishment, but also with financial compensation.
According to the prosecutor’s account of the events in his provisional allegations, on May 16, 2022, two of the defendants met the victims at the Burjassot-Godella metro station, where they had previously met.
After walking around the town, the minors took the girls to a public park and later suggested they enter an abandoned house, specifically to the lower floor of the house, where there was a room with two mattresses separated by a curtain.
The two couples of minors initially had consensual relations and asked the defendants to stop at a certain time, but they ignored them and raped them against their will, always according to the prosecutor’s account.
During the course of this attack, the defendants heard noises, so they stopped, got dressed and went outside the house, where they met three other minors, friends of the first, one of them under 14 years old.
The victims re-entered the abandoned house and, when one of them saw the rest of the attackers coming down after them, she hid. The other victim was held down by three of the accused and raped again in turns while she was held down by her arms and feet.
The minors, in addition to the physical injuries typical of an attack of these characteristics, have suffered various psychological problems.
