The Provincial Court of Ciudad Real has sentenced a teacher from the ‘Ángel Andrade’ school in Puertollano (Ciudad Real) to a 60-day fine with a daily fee of twelve euros for a minor crime of injuries, considering it proven that she gave a “smack” to a four-year-old child, conduct that, the magistrates say, “cannot be justified.”
In this way, the Court rejects an appeal filed by the teacher against a ruling by the Investigative Court number 3 of the industrial city.
Thus, the ruling of the Provincial Court consulted by Europa Press, of February 12, 2024, against which there is no appeal, considers as a proven fact that on May 26, 2022, at around 1:45 p.m., the teacher gave the child a “smack” with his right hand, which strongly impacted the left cheek and ear, while with his left hand he grabbed both of the little boy’s hands. As a result, the minor suffered a bruise on his left cheekbone and a slight abrasion on his neck.
The magistrates also condemn the teacher to pay the mother 32.91 euros for each of the three days that the minor needed to heal.
Although the Provincial Court recognizes that the child “behaved badly” and that he may require attention in accordance with his special needs, it grants complete veracity to the testimony of the mother, who took her son to the emergency room, where the injury was confirmed. compatible with the complainant’s story.
He also remembers that the mother collaborated with the center to try to solve her son’s behavioral problems, and that “the child’s bad behavior cannot justify that way of proceeding” on the part of the teacher.
For greater detail, the sentence continues, the witness examined in plenary, a teacher, declared that, although he could not see the incident because a column was blocking him, he did see that the mother, at the moment and without explanation, went towards the teacher. , picked up the child and left immediately, which, according to the Court, supports the thesis that “something happened that the witness did not see.”
It also emphasizes that the mother collaborated with the center to try to solve her son’s behavioral problems, and that the minutes of the meeting that the management team had with the complainant the day after the event show that the mother was willing to withdraw the complaint if the teacher recognized the facts and asked for forgiveness.
In statements to Europa Press, the mother confirmed that she herself witnessed the event, since at that time she was at the center, requested by the teaching staff, to observe the minor’s behavior.
In any case, he has clarified that his complaint only aims to protect the rights of the minor and prevent such events from being repeated, while recalling that he has not pursued any economic interest, since he went to the National Police in a specific context and that the money from the fine is not intended for her, but for the Court.
On the other hand, he thanked the involvement of the staff at the ‘Vicente Aleixandre’ school, where the boy is now, “who from the first moment devoted themselves to him and made him a happy child in the school environment.”
