The titular magistrate of the Court of First Instance and Instruction No. 9 of the judicial district of Arganda del Rey (Madrid) has agreed this Saturday to the reported provisional detention without bail of the inmate accused of killing his cellmate last Thursday in the prison of Estremera, where he was also the alleged perpetrator of the death of three brothers in Morata de Tajuña in December.
Dilawar F. will be investigated in this new case for the alleged commission of the crime of intentional homicide, although this criminal classification is initial and could be modified as the corresponding investigative procedures are carried out within the framework of the judicial investigation, as reported by the Superior Court of Justice of Madrid.
The titular magistrate of the Court of First Instance and Instruction No. 9 of the judicial district of Arganda del Rey has recused herself in favor of Court No. 8 of the same judicial district, which is the competent body in this matter given that it was the one on duty. at the time of the events and, therefore, the one who opened the preliminary proceedings and removed the body of the deceased.
After the event, the alleged murderer is alone in an isolation cell with glass, rigorous surveillance and a special search when he leaves and enters it for his two hours a day in the yard for a very serious disciplinary offense. Subsequently, he will go to first grade prison and possibly be transferred to another prison.
The key to the investigation is to know the motive for the crime, since in principle, according to the same sources, the two prisoners had no conflicts. In fact, they regularly played chess in the cell. Another important point is the murder weapon. The death was caused by blows with a blunt object.
Authorities have not reported what they found in the cell. On the one hand, it is considered that Dilawer could have made a device with materials from the prison itself. The other option would be that he had taken a dumbbell, disc or gym equipment, which would represent a serious security breach within the prison, since they are prohibited items in the dungeons.
The Pakistani citizen lived in module 12, which houses the most troublesome prisoners, with Ángel A.V., a Bulgarian who turned 40 last July and had a long history of gender violence, sexual assault, injuries and robberies. He did not act as Dilawar’s ‘shadow prisoner’, since he had not applied article 75.2 of the Penitentiary Regime and there was no risk of suicide.
Ángel was currently in provisional prison in Estremera for having cruelly mistreated his partner. He had already visited the prisons of Torrecica (Albacete) and Ocaña (Toledo) and had several negative prison reports for bad behavior.
Dilawar will undergo a medical examination to evaluate his psychological state and thus rule out any type of mental disorder. Upon entering prison, a medical and psychological examination was carried out, and no illnesses were detected. However, according to some neighbors of the alleged murderer, he regularly consumed hashish and marijuana.
The fourth crime attributed to this Pakistani citizen residing in Argadan took place around 2:30 a.m. this Thursday. Nobody knows if there was a previous argument, the inmates neighboring his cell only heard the blows and screams.
Then Dilawar called through the intercom and confessed what had happened. The module officials had not observed any problems or incidents that night, when the doors were closed normally after dinner.
The suspect, 42 years old, had been in the Estremera prison since January 24. Thus, he was once again behind bars after issuing the order for his entry by the Judge of First Instance and Instruction number 5 of Arganda del Rey, after surrendering two days earlier before the Civil Guard barracks of that town confessing to the murder of the three brothers because he did not They returned money that they supposedly owed him.
The magistrate made this decision to provisionally confine him due to the risk of escape and the possible alteration and/or destruction of evidence. During the hearing, the detainee acknowledged responsibility for the events, legal sources informed Europa Press at the time.
The judge sent him to the same prison where he served a short sentence a few months ago for attacking one of the murdered sisters with a hammer and kicking him. There were no incidents during that stay.
