According to the regional administration, this measure of grace would not be justified for those convicted who were involved in the creation of this fraudulent network that caused a black hole of almost 700 million euros in the public coffers since “there is no repentance” and “ “What was defrauded has not been returned.”

“There are weaknesses in the request,” says Nieto, who has insisted that the Junta does not want to make this “a political weapon.” Furthermore, and with respect to the specific case of Griñán, the only person convicted in this case who has not been imprisoned due to suffering from prostate cancer that makes his treatment and recovery “incompatible” with being in prison, according to the Institute’s forensic expert. The defense of the former leader of Andalusian socialism has alleged that neither the Andalusian Government is a party to these actions in question nor does the prison sentence imposed on the former Andalusian president include damage or conviction for civil liability, which is why the representation of the former president warns that they are not harmed in these specific actions.

For this reason, the representation of José Antonio Griñán requests in his appeal to annul the aforementioned ruling of the Court. In the case of Griñán, last June 2023, the First Section of the Seville Court agreed to suspend his entry into prison for five years thanks to the prostate cancer that he suffers from and in accordance with article 80.4 of the Penal Code.

There is no regret or return of the defrauded amounts, Nieto has insisted when addressing this matter. To date, the Board, as it has advanced, has initiated the claim for 70 million euros, 10% of the total, thanks to the fact that the final rulings that have been issued are guaranteeing that the Board can claim the refund. .

At this point, however, the Minister of Justice has been “pessimistic” regarding being able to recover a large part of what was defrauded since many of the defendants are declaring themselves insolvent, among other issues.
