The parliamentary groups of Esquerra (ERC), Bildu and Junts have preferred not to participate in the Calvo exam, whose ideological profile they have questioned due to the vehemence with which the candidate rejected the Amnesty Law promoted by the independence associations in 2021 and which she called, among others, “unconstitutional” and “invasive of the Judiciary.”

Calvo will be appointed as president of the Council of State after the previous incumbent, Magdalena Valerio, ceased to hold office because the Supreme Court annulled her appointment considering that she did not meet the legal requirement of “jurist of recognized prestige” required by the organic law. that regulates the institution. The same one that PP, Vox and UPN have questioned.

During his appearance, Calvo defended himself against criticism by pointing out that prestige is an “indeterminate” legal concept and regretted that the knowledge accumulated during the years he has held positions of political responsibility cannot be taken into account.

Despite voting in favor, Calvo’s candidacy has been criticized by members of Sumar and Podemos for being “a person who has clearly defended transphobic positions” given his position against the Trans Law promoted by Minister Irene Montero.

However, Carmen Calvo has defended her appointment by framing it in the “usages and customs” of politics in Spain and in “any democracy.”
