In March of 2022, Manhattan Judge Carol Sharpe made a controversial ruling, placing Kohler under a court-appointed guardianship against her explicit wishes and documented desires. Despite having a substantial $870,000 in her account at the time, Kohler was stripped of her financial freedom and autonomy.

Amidst allegations of financial elder abuse, the guardianship was justified by claims from Kohler’s condo building landlord, casting suspicion on her loyal friend, Inga Eggerud. After 16 months of turmoil, the guardianship was finally overturned by New York’s Appellate Division in November 2023, vindicating Eggerud and reinstating her as Kohler’s power of attorney. Eggerud’s lawsuit, seeking reparation for defamation and intentional infliction of emotional distress against Kohler, has sent shockwaves through the legal community. While the defendants have vehemently denied the allegations, a trial court judge’s recent ruling has allowed major claims to proceed against the law firm representing the landlord.

As the case gains momentum, Barbara Goodstein, a key figure in the saga, has shed light on the opaque nature of the guardianship system. With vast sums of money at stake and little accountability, Goodstein warns of the systemic issues plaguing the guardianship industry.
“There is no visibility into this entire system,” expressed Goodstein. “This case is going to end up breaking ground in this space because so many people have made an industry out of this.”
