The famous Bar Pinotxo de la Boqueria, which this February was transferred from the family of the famous Juanito Bayén (waiter and architect for more than 75 years of this establishment) to a new operator, will have to find a new name in order to continue bringing out his activity.
This has been dictated by the Mercantile Court number 9 of Barcelona, ??which has ordered a precautionary measure requiring Restaurante Egipto SLU, the new operator that reopened the premises just 20 days ago, to “immediately cease use of the Pinotxo Bar denomination”.
The reason is that the part of the Bayén family that was excluded from the decision to transfer the business has claimed that they want to preserve the name and family spirit in a new location at La Boqueria, although “unfortunately they will not be able to do so at the stops that Mr. Juanito (Bayén) has yielded to a third party,” they explained in a statement released through their law firm, Sol Muntañola.
As already explained at the time, everything indicated that it would be Jordi Asín Bayén who would continue to carry out Bar Pinotxo with the help of his wife and son after the retirement of his uncle Juanito Bayén at the age of 89. But it was not like that. Although Asín has been co-owner of the premises since 2001, the Bar Pinotxo was transferred in February to another businessman from La Boqueria, who also owns the Central Bar and various businesses on La Rambla.
Bayén’s nephew, who in the statement ensures that his uncle has been “remote-controlled” in the transfer process, has now demanded the transfer of the intellectual property rights of the brand, seeing what happened as “unjustifiable” and difficult to understand.
In the document they also explain that “the family is aware that this situation is going to be difficult to repair”, given the personal and image damage suffered, the loss of the location in La Boqueria, as well as “enormous economic damages. But the restitution of their rights and the reparation of the damage will be sought, using as many legal actions as they can assist them,” he concludes.
